On September 24, 2020, ECHA issued an enforcement report. The focus of enforcement is the restriction requirements of Annex XVII of the REACH Regulation, focusing on the inspection of lead, cadmium, and mercury in commodities. The compliance status of chromium, polycyclic aromatic hydrocarbons and phthalates was checked. In the inspection of restricted substances on 1,225 products, 221 products (17%) were found to be non-compliant, of which 155 non-compliant products from China, accounting for about 73.5 of the total number of products that did not meet REACH restrictions %. Therefore, importers of articles containing chemical substances must ensure that products placed on the EU market comply with REACH obligations to reduce unnecessary losses.

The inspection results of this project mainly come from the national law enforcement agencies and customs inspectors of 16 member states at their entry points (such as airports and ports) and customs offices on 1,389 products from 37 countries (of which about 71% of the products are from China) Of sampling. The report shows that 23% of more than 300 products do not comply with REACH and CLP regulations.

The law enforcement report pointed out that EU importers need to increase their efforts to provide safe products that meet the requirements of REACH and CLP regulations. In addition, the EU official also stated that the follow-up still needs to implement targeted enforcement against these specific restrictions, and enforce REACH and CLP enforcement activities more strictly at the EU border.
